Judge: Paterno family can't suit NCAA, PSU for breach of contract
A Pennsylvania judge ruled Monday that the family of late Penn State coach Joe Paterno cannot sue the NCAA or the university for breach of contract.
Per the Associated Press, the Paterno estate has argued that the NCAA and university violated the rights of the late coach with the way the Jerry Sandusky sexual abuse scandal was handled. That includes the signing of the 2012 consent decree that questioned Paterno’s response to allegations made against Sandusky. Sandusky, the longtime PSU defensive assistant, was sentenced in June 2012 and will spend the rest of his life in prison
Judge John Leete dismissed the breach-of-contract claim in the Paterno family’s lawsuit, which had been previously amended.
“Plaintiffs are not amending their complaint to include a new cause of action or even a new theory of an existing cause of action; rather they are attempting to resurrect a claim on which this court already dismissed,” Leete wrote in his decision.
Aside from Leete dismissing the breach-of-contract portion of the lawsuit, the rest of the lawsuit will proceed. However, Leete did turn down a few other requests from the Paternos, who are suing defendants from the NCAA for commercial disparagement.
From the AP:
On Monday, Leete also turned down the Paternos' request to let them make public more of the material they are getting from the NCAA. And he rejected a request from the NCAA that would have required the Paterno estate's lawyers to conduct depositions of some people before they issue subpoenas.
A lawyer representing the NCAA said the organization will “continue to defend vigorously” what remains in the lawsuit.
The NCAA issued a statement that said Leete's decision means the organization did not breach any obligation it owned Paterno, under its rules, when it and Penn State entered into the consent decree.
Former Penn State assistants Bill Kenney and Jay Paterno, Joe’s son, are also plaintiffs in the case. They claim that the NCAA has hindered them from finding college coaching positions since not being retained on PSU’s staff after Paterno’s tenure came to an end.

Oklahoma suspends RB Keith Ford for rule violations
Oklahoma running back Keith Ford has been indefinitely suspended for academic and team rules violations, coach Bob Stoops announced Monday.
Ford rushed for 369 yards and five touchdowns in eight total games with three starts, but saw his carries decrease after suffering a broken fibula against Tennessee and the emergence of Samaje Perine.
Before being injured, Ford led the Big 12 in scoring through the first three games.
Ford’s suspension opens up a very crowded backfield for the Sooners. Perine, an All-American, is the incumbent, followed by junior Alex Ross, sophomore Daniel Brooks and freshmen Joe Mixon and Rodney Anderson, who suffered a sprained MCL and will miss the rest of spring practices.

Cincy QB Jarred Evans says racial taunts led to punch
Cincinnati backup quarterback Jarred Evans testified in court on Friday to defend the punch he threw in October that led to a misdemeanor assault charge and his suspension from the team.
According to the Cincinnati Enquirer, Evans testified that racial taunts toward he and his girlfriend led to the punch that knocked 20-year-old Ryan Smith unconscious.
From the Enquirer:
Jarred Evans and his girlfriend, her arm wrapped in his, were walking along a Clifton street as bars were closing when they heard a series of racist remarks from a group of men, Evans testified.
"N----- lover," one of the college-age men said to the couple. Evans is black, his girlfriend is white.
The group – Evans estimated there were three or four men – drew closer, he said Friday during the fourth day of testimony in his trial in Hamilton County Municipal Court.
Evans told the court that he tried to ignore the men as he walked toward his apartment, but felt threatened as the group continued saying racist comments.
Eventually, Evans responded: "I told them, 'I will (expletive) all of you up if you come after me."
Soon after, he testified, one of the men stood in front of them, blocking their path.
"He flinched at me with his hands up," Evans testified, "and I just reacted with a punch, a jab."
The single punch sent Ryan Smith, a 20-year-old sophomore, face-down to the sidewalk, unconscious.
Evans’ girlfriend, 22-year-old Jenna Dunlap, testified that Smith blocked their path but that she “covered her face and didn’t see the punch.”
“The (next) thing I know, I saw a dude on the ground,” she said. “I had tears in my eyes. I’d never seen anything like this.”
Smith had a completely different account of the events.
Smith testified earlier this week that he didn't say anything to Evans, didn't step into his path, and wasn't with the group of men. In fact, he said he didn't see who threw the punch that knocked him out. He said he woke up in a hospital bed. He suffered a concussion and a cut to his forehead that required a dozen stitches.
Courtney Gravett, Dunlap’s roommate, backed up Smith’s claims.
Courtney Gravett, who is Dunlap's roommate, said Smith was walking about 10 to 15 feet behind the group. Gravett said she tried to stop Evans from confronting the men. For no obvious reason, she testified, Evans struck Smith, who had his head down and his hands in his pockets.
Gravett also said she had been drinking with Evans and Dunlap at a local bar that night and that the couple had an argument. Dunlap denied these claims and Evans said he did not drink that night.
The incident occurred after the Bearcats’ 41-3 over SMU in Houston. Evans threw for 10 yards and ran for 67 yards and a score in the win.

Reports: Alabama WR Cam Sims suffers torn ACL
It was a rough weekend for Alabama.
In addition to the arrests of defensive lineman Jonathan Taylor (who was dismissed) and safety Geno Smith, the program received bad news when sophomore wide receiver Cam Sims went down with an injury during Saturday’s practice. According to Al.com, Sims suffered a torn ACL.
With Alabama’s top three wide receivers from the 2014 season – Amari Cooper, DeAndrew White and Chris Jones – out of the picture, Sims was projected to be a candidate to move into a starting role alongside junior Chris Black and sophomores ArDarius Stewart and Robert Foster.
The 6-foot-4, 208-pound Sims caught seven passes for 62 yards and a touchdown in 12 games as a true freshman for the Crimson Tide last season. A native of Monroe, La., Sims was a Rivals.com four-star recruit in the 2014 class who was rated as the 174th-best player in the country.
Coming off a 12-2 season, the Crimson Tide is scheduled to get back on the field for its spring game on April 18.
